1. 라이선스 부여

Europe In Frame은 본 약관에 따라 라이선스 이용자에게 라이선스 대상 사진을 편집 목적으로 사용할 수 있는 비독점적이고 양도 불가능한 전 세계 라이선스를 부여합니다.

이 라이선스는 관련 주문 또는 라이선스 기록에 명시된 사진에만 적용됩니다.

2. 기간

이 라이선스는 본 약관을 준수하는 조건으로 무기한 부여됩니다.

3. 허용되는 편집 사용

라이선스 대상 사진은 다음에 사용할 수 있습니다.
- 편집 기사;
- 도서;
- 신문 및 잡지;
- 뉴스 간행물;
- 교육 간행물;
- 다큐멘터리 간행물;
- 본 약관에 부합하는 그 밖의 비광고성 편집 간행물.

사진은 이 라이선스의 범위 안에서 디지털 또는 인쇄 편집 간행물에 사용할 수 있습니다.

4. 상업적, 광고 및 홍보 사용

이 라이선스에서는 상업 광고, 홍보 캠페인, 제품 마케팅, 보증 및 그 밖의 홍보 또는 광고 용도를 허용하지 않습니다.

상업 출판사나 그 밖의 상업 조직이 사진을 사용하더라도, 실제 사용이 편집 목적이고 그 밖의 모든 사항이 본 약관을 준수한다면 해당 조직이 상업적으로 운영된다는 이유만으로 금지되지는 않습니다.

5. 제한적인 수정

라이선스 이용자는 크기 조정, 자르기, 일반적인 색상 또는 노출 조정 등 허용된 편집 사용에 필요한 합리적인 기술 및 편집 조정을 할 수 있습니다.

사진을 기만적인 방식으로 중대하게 변경하거나 사진의 피사체, 맥락 또는 의미를 왜곡하도록 수정할 수 없습니다.

이러한 조정으로 저작권이 이전되거나 라이선스 대상 사진에 대한 소유권이 생기지 않습니다.

6. 저작자 표시

저작자 표시가 필요합니다.

합리적으로 가능한 경우 크레디트는 다음과 같이 표시해야 합니다.

간행물 형식상 해당 위치나 형식을 합리적으로 사용할 수 없는 경우에는 관행에 맞고 합리적으로 눈에 띄는 편집 크레디트 위치에 표시해야 합니다.

7. 지역

이 라이선스는 전 세계에서 유효합니다.

8. 재판매, 재라이선스 및 재배포

라이선스 대상 사진은 다음과 같이 사용할 수 없습니다.
- 독립 자산으로 재판매;
- 재라이선스;
- 독립적인 라이선스 자산으로 다른 사람 또는 조직에 양도;
- 독립적으로 다운로드할 수 있는 파일로 재배포;
- 공개 파일 저장소 또는 파일 공유 서비스에 업로드;
- 스톡 라이브러리, 템플릿, 자산 묶음 또는 이미지 컬렉션으로 제공;
- 사진 자체가 주된 가치를 이루는 제품에 포함.

허용된 편집 사용을 위해 라이선스 이용자를 대리하는 인쇄업체, 출판사, 디자이너 또는 제작업체에 기술적으로 필요한 범위에서만 사진을 제공하는 것은, 해당 수령인에게 사진을 독립적으로 사용할 권리가 부여되지 않는 한 금지된 재배포로 간주하지 않습니다.

9. 인공지능 및 기계학습

Europe In Frame이 별도의 서면 허가를 부여하지 않는 한, 라이선스 대상 사진을 인공지능 또는 기계학습 모델의 훈련, 미세 조정, 평가 또는 개발에 사용하거나 그러한 목적의 데이터 세트에 포함할 수 없습니다.

10. 소유권 및 저작권

라이선스 대상 사진의 저작권과 모든 소유권은 저작권자에게 남습니다.

사진을 구매하거나 라이선스를 취득해도 기초가 되는 사진 저작물의 저작권, 저작자 지위 또는 소유권은 이전되지 않습니다.

이 라이선스는 사용권만 부여합니다.

11. 금지되는 사용

라이선스 대상 사진은 다음과 같이 사용할 수 없습니다.
- 불법적인 사용;
- 기만적으로 또는 중대하게 오해를 일으키는 편집 맥락에서 사용;
- 라이선스 이용자 본인이 촬영한 원본 사진 저작물인 것처럼 표시;
- 후원, 보증 또는 제휴 관계를 허위로 암시하는 방식으로 사용;
- 이 라이선스에서 명시적으로 부여한 편집 권리 범위를 벗어난 사용.

12. 종료

라이선스 이용자가 본 약관을 중대하게 위반하고, 시정 가능한 위반임에도 통지를 받은 뒤 합리적인 기간 안에 시정하지 않는 경우 Europe In Frame은 이 라이선스를 종료할 수 있습니다.

라이선스가 종료되면 라이선스 이용자는 더 이상 이 라이선스로 허용되지 않는 모든 사용을 중단해야 합니다.

종료는 준거법에 따라 이용 가능한 강행적 권리나 구제 수단에 영향을 미치지 않습니다.

13. 강행적 권리

이 라이선스의 어떠한 내용도 준거법상 합법적으로 배제, 제한 또는 축소할 수 없는 권리, 구제 수단, 보증 또는 보호를 배제하거나 제한하지 않습니다.

강행법과 이 라이선스 약관이 충돌하는 경우에는 그 충돌 범위에서 강행법이 우선합니다.

14. 라이선스 버전

본 문서는 편집용 표준 라이선스 약관 버전 1.0입니다.

구매에 적용되는 라이선스는 관련 주문에 명시되고 기록된 버전입니다.

EDITORIAL STANDARD LICENCE
Version 1.0

1. Licence grant

Europe In Frame grants the licensee a non-exclusive, non-transferable, worldwide licence to use the licensed photograph for editorial purposes, subject to these terms.

The licence applies only to the photograph identified in the relevant order or licence record.

2. Duration

The licence is granted for an indefinite period, subject to compliance with these terms.

3. Permitted editorial use

The licensed photograph may be used in:
- editorial articles;
- books;
- newspapers and magazines;
- news publications;
- educational publications;
- documentary publications;
- other non-advertising editorial publications consistent with these terms.

The photograph may be used in digital or print editorial publications within the scope of this licence.

4. Commercial, advertising and promotional use

Commercial advertising, promotional campaigns, product marketing, endorsements and other promotional or advertising uses are not permitted under this licence.

Use by a commercial publisher or other commercial organisation is not prohibited merely because the organisation operates commercially, provided that the actual use of the photograph is editorial and otherwise complies with these terms.

5. Limited modifications

The licensee may make reasonable technical and editorial adjustments required for a permitted editorial use, including resizing, cropping and ordinary colour or exposure adjustments.

The photograph may not be materially altered in a deceptive manner or modified so that it misrepresents the subject, context or meaning of the photograph.

Such adjustments do not transfer copyright or create ownership rights in the licensed photograph.

6. Attribution

Attribution is required.

Where reasonably practicable, the credit must read:

If the publication format does not reasonably permit that exact placement or form, the credit must be provided in a customary and reasonably visible editorial credit location.

7. Territory

The licence is valid worldwide.

8. Resale, sublicensing and redistribution

The licensed photograph may not be:
- resold as a standalone asset;
- sublicensed;
- transferred to another person or organisation as an independent licensed asset;
- redistributed as a standalone downloadable file;
- uploaded to a public file repository or file-sharing service;
- offered in a stock library, template, asset pack or image collection;
- incorporated into a product whose primary value is the photograph itself.

Supplying the photograph only as technically necessary to a printer, publisher, designer or production provider acting on behalf of the licensee for a permitted editorial use does not constitute prohibited redistribution, provided that the recipient receives no independent right to use the photograph.

9. Artificial intelligence and machine learning

The licensed photograph may not be used to train, fine-tune, evaluate or develop an artificial intelligence or machine-learning model, or included in a dataset intended for such purposes, unless Europe In Frame grants separate written permission.

10. Ownership and copyright

Copyright and all ownership rights in the licensed photograph remain with the copyright holder.

Purchasing or licensing the photograph does not transfer copyright, authorship or ownership of the underlying photographic work.

This licence grants usage rights only.

11. Prohibited use

The licensed photograph may not be:
- used unlawfully;
- used deceptively or in a materially misleading editorial context;
- represented as the licensee's own original photographic work;
- used in a way that falsely suggests sponsorship, endorsement or affiliation;
- used outside the scope of the editorial rights expressly granted by this licence.

12. Termination

Europe In Frame may terminate this licence if the licensee materially breaches these terms and, where the breach is capable of remedy, fails to remedy it within a reasonable period after receiving notice.

Upon termination, the licensee must cease any use that is no longer authorised by this licence.

Termination does not affect any mandatory rights or remedies available under applicable law.

13. Mandatory rights

Nothing in this licence excludes, restricts or limits any right, remedy, guarantee or protection that cannot lawfully be excluded, restricted or limited under applicable law.

Where mandatory law conflicts with these licence terms, the mandatory law prevails to the extent of that conflict.

14. Licence version

These are the Editorial Standard Licence terms, version 1.0.

The licence applicable to a purchase is the version identified and recorded with the relevant order.
